The following SoP has been enforced for Patent filing/Copyright registration:
- Validate/check the novelty of your idea/invention with the help of a prior art report from authorized sources (RPBD/CSIR-URDIP)
- Draft patent specification as per CSIR guidelines in compliance with the Indian patents act, 1970
- Submit the patent specification to the IP Coordinator for the reviewer's comments
- Incorporate the Reviewer’s recommendations and mail the revised patent specification in doc/Docx format along with the names of the inventors, project details, and assignee to the IP Coordinator for IP notification
- Patent/copyright will be notified on the e-notice board for receiving any objections. In case of any objection, the case will be forwarded to a statutory committee for an amicable resolution
- After notification, the patent specification (provisional or complete) in doc/Docx format along with (i) filled out Form-1, Invention Disclosure Form (IDF) and Transfer of IP rights (for Temporary staff), plagiarism checking report, and prior art report are to be uploaded in OneCSIR-ERP
- All forms of IP filings/registrations shall be approved through ERP
- After ERP approval, the Inventor has to submit the following hardcopy documents to the IP Coordinator– 3 Copies of Patent specification (one side printout), 8 sets of filled-out form-1 (one side printout) duly signed by all the inventors, #2copies of IDF, and transfer of IP rights (for temporary staff) duly signed by the corresponding PL, plagiarism checking report and prior art report. Also, a softcopy of all those documents has to be given on a CD.
- In case of copyright applications - (1) CDs (Four Copies) Containing Source Code, Object Code & Machine-Readable Form, (2) #3 copies of the document containing Source code, abstract, input/output, Authorship Declaration Form (6 copies) duly signed by all the authors, (3) software evaluation form (3 copies)
- IP Coordinator will write to the Head, CSIR-IPU, New Delhi for filling/registration and communicate the CSIR-IPU reference number for the same
- Inventors should not disclose any part of the invention in any media until they receive the Application Number assigned by Indian Patent Office
- The IP filing status will be communicated to the Inventors/notice board after receiving the same from CSIR-IPU
- Power of Attorney (Form-26) must be submitted in case of joint application
